AB1765 – Screening Fee Receipts (Effective 1/1/2024) Emails are now an acceptable method for sending tenant screening receipts.
SB602 – Trespass Letters (Effective 1/1/2024) Rental units are required to have a business license. Within 30 days of vacancy, the owner must report the uninhabited status of the rental property to the city. After reporting, the owner may post a “No Trespassing” sign, provided the local municipality has been properly notified.
AB12 – Security Deposit (Effective 7/1/2024) Security deposits, including for rent, pets, and other charges, are capped at one month’s rent. An exemption exists for owners who have two or fewer properties, with a total of four units or fewer.
SB712 – Tenancy Mobility Devices Tenants are allowed to store electronic mobility devices, such as e-bikes, inside the unit or in an approved outdoor location, as long as the batteries comply with government regulations. If the batteries do not meet these standards, the owner may require the tenant to provide insurance.
AB1482 (Amendment) – Tenant Protection Act (Effective 3/26/2024)
• Owners wishing to move family members or themselves into the unit, or to conduct substantial repairs, must give
proper notice and occupy the unit for at least 6 months. Failure to comply results in severe penalties.
• Notice requirements: The owner or family member must move in within 90 days of the tenant vacating. If no eviction
is required, a 6-month residency is mandatory.
• Eviction requirements: The notice must include the name of the person (owner or family member) moving in, and no
other similar vacant units on the property should be available for the owner/family member to move into instead of
evicting a tenant.
CCP 1946.2 – Eviction Without Cause To evict without cause under AB1482, the tenant must have continuously occupied the unit for at least one year.
AB1620 – Permanent Disabilities (Effective 1/1/2024, Applies Only When Rent Control Exists) Tenants may request to pay the same rent for a different unit within the same community or complex if they have a permanent disability.
SB267 – Credit History and Government Rent Subsidy (Effective 1/1/2024) Landlords cannot use a tenant’s credit history as part of the application process if they are receiving a government rental subsidy, unless the applicant is given the opportunity to provide alternate proof of reliable income.
AB2801 – Security Deposits
• Landlords must take photos of the rental property immediately before the tenant moves in (effective 7/1/2025).
• Landlords must take photos of the property immediately after the tenant moves out, and include before-and-after
repair photos when returning the security deposit (effective 4/1/2025).
• Landlords may not deduct carpet cleaning costs from the security deposit unless the cleaning is necessary to restore
the unit to its original condition (effective 4/1/2025).
AB2347 – Response to Eviction Notices (Effective 1/1/2025)
Tenants now have 10 business days (up from 5) to respond to an in-person service of an unlawful detainer. Prejudgment defaults may be filed only after 10 business days.
AB1482 – Tenant Protection Act of 2019
Single-family homes and condominiums are exempt unless owned by an LLC or REIT, in which case they are subject to AB1482 along with duplexes, triplexes, apartments, and other multifamily units.
AB2747 – Rent Reporting
AB 2747 requires landlords in California to offer renters the option to have their positive rental payment information reported to a nationwide consumer reporting agency, starting with leases on or after April 1, 2025. Renters can choose to opt-in, and if they do, their consistent rent payments will be used to help improve their credit profiles. Landlords must offer this option at lease signing and once annually thereafter, with a fee for the service capped at $10 per month or the actual cost incurred. Renters can cancel the reporting, but must wait six months before re-enrolling. The law exempts landlords of small residential buildings (15 units or fewer) and certain assisted housing developments. Delinquent payments are not reported.
